Según los Anales Eclesiásticos de Ortiz de Zúñiga la Hermandad del Cristo de la Corona gozó de gran devoción popular durante los siglos del barroco, estableciéndose en la antigua capilla del Sagrario de la catedral hispalense desde sus orígenes. Tras la inauguración del nuevo templo en 1661 la hermandad se trasladó a su actual capilla en el nuevo Sagrario en 1716. La nueva capilla, con sus dos retablos, han configurado desde el pasado la imagen actual del nazareno de la Hermandad (...) de la Corona. La escultura, talla anónima del último tercio del siglo XVI, presenta el abrazo de Cristo a la cruz antes de su muerte, rescatando modelos iconográficos procedentes de Italia o Alemania a través de los grabados, y desarrollados a través de representaciones pictóricas, como las de Sebastiano del Piombo. La archidiócesis hispalense estuvo marcada en el último tercio del siglo XVII por el gobierno del arzobispo don Jaime de Palafox y Cardona (1685-1701), cuyo pontificado estuvo marcado por los continuos pleitos que mantuvo con los diferentes cabildos de la ciudad. Su actividad como patrono y mecenas de las artes quedó difuminada por su intensa labor en la defensa de la inmunidad eclesiástica, pero sus devociones personales hacia el Santísimo Sacramentado, a Santa Teresa de Jesús, a Santa Rosalía, además de (...) la admiración y respeto que sintió por el sacerdocio, tendrán una fuerte repercusión en la religiosidad y la estética de la Sevilla de finales de siglo XVII, manifestándose en diversas expresiones artísticas en la ciudad y en la promoción de edificios dedicadosa dichas advocaciones. El cardenal don Francisco de Solís Folch de Cardona murió en Roma el 12 de abril de 1775. Con una dilatada carrera cortesana y eclesiástica vivió una vida holgada, sus excesos económicos, su tren de vida y sus atenciones a los necesitados fueron las características más relevantes de su personalidad como prelado. Al igual que en Roma, Sevilla celebró solemnes exequias en su memoria, y un año más tarde se depositó su corazón en el convento de capuchinas de Santa Rosalía, (...) como era su deseo. Antes de su último viaje a Italia, en 1766 dejó rubricado un documento con sus últimas voluntades, en él dejaba como heredero universal al deán y cabildo de la catedral de Sevilla, y nombrados a todos sus albaceas, provocando entre ellos una serie de conflictos de difícil solución. El artículo concluye con la aportación de un anexo con la transcripción de una copia del testamento del cardenal don Francisco de Solís Folch y Cardona que solicitó su hermano y albacea, don Alonso de Solís Folch de Cardona, IV duque de Montellano. Brette contends that the neural coding metaphor is an invalid basis for theories of what the brain does. Here, we argue that it is an insufficient guide for building an artificial intelligence that learns to accomplish short- and long-term goals in a complex, changing environment.

Many arguments have been made against gene editing. This paper addresses the commonly invoked argument that gene editing violates human dignity and is ultimately a subversion of human nature. There are several drawbacks to this argument. Above all, the concept of what human dignity means is unclear. It is not possible to condemn a practice that violates human dignity if we do not know exactly what is being violated. The argument’s entire reasoning is thus undermined. Analyses of the arguments involved (...) in this discussion have often led to the conclusion that gene editing contravenes the principle of genetic identity (genetic immutability) thereby subverting a requisite of human dignity and ultimately threatening human nature. This paper refutes these arguments and shows that any opposition to gene editing cannot rely on the human dignity argument. (shrink)

Resumen La capacidad de la angustia de desvelar lo oculto está en relación con la esencial actividad des-encubridora del Dasein. Así, la reflexión respecto de la angustia se enmarca en el proyecto trascendental de la fenomenología, aun desde la renovación hermenéutica operada por Heidegger. La angustia podría ser entonces una forma preteórica de reducción, lo que aquí se llamará reducción ontológica. De esta manera, la angustia pone en valor las disposiciones afectivas en el proyecto alético, siempre inacabado, de pensar lo (...) hasta ahora no pensado.The ability of anguish to reveal the hidden is, evidently, in relation to the essential uncovering activity of Dasein. This proposal continues the transcendental perspective of phenomenology even from the Heidegger’s hermeneutic renewal. Anguish could be a pre-theoretical way of reduction; what we will call here ontological reduction. In this way, the anguish puts in value the affective dispositions in the project of thinking something which, until now, has not been thought. (shrink)

Although Chinese law imposes informed consent for medical treatments, the Chinese understanding of this requirement is very different from the European one, mostly due to the influence of Confucianism. Chinese doctors and relatives are primarily interested in protecting the patient, even from the truth; thus, patients are commonly uninformed of their medical conditions, often at the family’s request. The family plays an important role in health care decisions, even substituting their decisions for the patient’s. Accordingly, instead of personal informed consent, (...) what actually exists is ‘family informed consent’. From a Western perspective, these features of Chinese law and Chinese culture might seem strange, contradicting our understanding of doctor-patient relationship and even the very essence of self-determination and fundamental rights. However, we cannot forget the huge influence of cultural factors in these domains, and that ‘Western’ informed consent is grounded on the individualistic nature of Western culture. This article will underline the differences between the Western and the Chinese perspectives, clarifying how each of them must be understood in its own cultural environment. But, while still respecting Chinese particularities, this paper advocates that China adopt patient individual informed consent because this is the only solution compatible with human dignity and human rights. The events surrounding COVID-19, combined with the mandatory quarantines widely imposed in Asia and Europe since the virus outbreak, have reignited discussion of the balance between individual rights and liberties and public health during epidemics and pandemics. This article analyses this issue from the perspectives of precaution and necessity. There is a difficult relationship between these two seemingly opposite principles, both of which are frequently invoked in this domain. Although the precautionary principle encourages the use of quarantines, including mandatory quarantines, (...) and associated restrictive measures, the principle of necessity puts a break on such measures. The COVID-19 pandemic reveals once again the different interrelations between these two principles. However, the alleged conflict between the PN and the PP is based on a superficial analysis. The relation between these two principles is far more complex, as this article will demonstrate. (shrink)

El artículo trata de plasmar cómo la influencia de Pablo de Tarso en Heidegger puede explicar no sólo la concepción de la Zeitlichkeit como sentido del ser del ente que es el Dasein, sino el concepto de tiempo después de la Kehre. Si aquella concepción escatológica hizo del futuro el éxtasis principal de la existencia que se sabe tan abierta y proyectiva como caída y deyectada por la muerte adveniente, esta otra dimensión mesiánica insiste más en el tiempo que resta, (...) en el presente que nos queda. De este modo, en las dos grandes etapas de Heidegger podrían encontrarse resonancias de las dos determinaciones del kairós que, en nuestra opinión, traslucen las epístolas paulinas. (shrink)

The Director-General of the WHO has suggested that China’s approach to the COVID-19 crisis could be the standard of care for global epidemics. However, as remarkable as the Chinese strategy might be, it cannot be replicated in other countries and certainly not in Europe. In Europe, there is a distribution of power between the European Union and its member states. In contrast, China’s political power is concentrated in the central government. This enables it to take immediate measures that affect the (...) entire country, such as massive quarantines or closing borders. Moreover, the Chinese legal framework includes restrictions on privacy and other human rights that are unknown in Europe. In addition, China has the technological power to easily impose such restrictions. In most European countries, that would be science fiction. These conditions have enabled China to combat epidemics like no other country can. However, the WHO might have been overoptimistic. The Chinese standard of care for treating COVID-19 also raises problematic issues for human rights, and the real consequences of these actions remain to be seen. (shrink)

El ser humano precisa de la técnica para vivir y desarrollarse en todas sus dimensiones, biológicas, sociales y espirituales. La técnica, por su parte, cobra sentido cuando es puesta precisamente al servicio del desarrollo humano. Pero lo técnico ha ido desplegándose a lo largo de la historia en diversas modalidades: de la simple técnica hemos pasado a la tecnología, después a la tecnociencia, de ahí a la biotecnología y, en última instancia, a la antropotecnia. En los últimos años algunos pensadores (...) han propuesto emplear lo técnico sobre el propio ser humano, para transformarlo en un ser posthumano. Tanto Husserl como la escuela de Frankfurt habían denunciado ya la pérdida del sentido provocada por la absolutización de la razón instrumental. Nosotros detectamos que el riesgo del sinsentido se intensifica cuando lo técnico se aplica sin criterio, sin otra razón que la puramente instrumental, sobre el propio ser humano. Argumentamos que, si este proyecto antropotécnico se cumpliese, probablemente lo técnico mismo perdería su sentido y vería posiblemente debilitado su propio crecimiento. Entendemos que la respuesta, con todo, no ha de ir en la línea neoludita, sino en la línea de la actitud que Heidegger denominó serenidad. (shrink)

Se investiga en este trabajo la posibilidad de hacer una fenomenología de la experiencia del mal gradualmente considerada desde la más conspicua consideración del acto criminal, hasta los comportamientos más sutiles en relación con la maldad. Se apunta, además, que uno de estos niveles de maldad menos evidentes podría acontecer en lo que aquí se denomina sospecha de la intención que se define como el intento de intromisión en la libertad interna del otro. ResumenLa disputa del positivismo materializó la polémica entre frankfurtianos y popperianos. Pero esta oposición ha sido tan malentendida como exagerada. Entre ambas filosofías existen interesantes vinculaciones y afinidades que remiten a una raíz común: Kant. Y en pensar, también, las aportaciones del periodismo informativo y del sistema de medios al ideal de una democracia deliberativa. Contribución y aportación que configuran lo que aquí se denomina la faz republicana del periodismo informativo. Esto es, la dimensión teórico-política del periodismo en términos de compromiso con el sistema democrático. En la (...) sociedad de la información, recuperar el ideal de la vida buena para la construcción de una democracia auténtica pasa por disponer de información así como de mecanismos de canalización que posibiliten la participación ciudadana. ¿Pueden satisfacer los medios de comunicación estas dos notas constitutivas de la virtud ciudadana contemporánea? Most courts around the world have been refusing wrongful life actions. The main argument invoked is that the supposed compensable injury cannot be classified as such, since life is always a blessing no matter how hard and painful it is.In opposition to mainstream scholars and the dominant case law, this article sustains that life must be distinguished from living conditions, the former being the real injury at stake, since some living conditions are so intolerable that in themselves they justify a (...) compensation within wrongful life actions. The use of reproductive techniques and the eventual reproductive negligence from the provider of reproductive services gave rise to situations in which the intended parents are deprived of raising a child genetically connected to them. Courts have been dealing with cases of those for years, but have systemically denied claimants compensation, failing to recognise as damage the loss of genetic connection. In 2017, for the first time, the Singapore High Court provided compensation for that damage, labelled “loss of genetic affinity”. (...) This paper will argue that the damage in question is the loss of genetic connection and results from a violation of reproductive rights because a key element of reproductive rights is to have children with whom we keep a genetic bond and raise them. The paper will explain why the arguments classically argued against such compensation are unfounded and it will argue for a compensation covering both patrimonial and non-patrimonial damages. Facial recognition is an artificial intelligence-based technology that, like many other forms of artificial intelligence, suffers from an accuracy deficit. This paper focuses on one particular use of facial recognition, namely identification, both as authentication and as recognition. Despite technological advances, facial recognition technology can still produce erroneous identifications. This paper addresses algorithmic identification failures from an upstream perspective by identifying the main causes of misidentifications (in particular, the probabilistic character of this technology, its ‘black box’ nature and its algorithmic (...) bias) and from a downstream perspective, highlighting the possible legal consequences of such failures in various scenarios (namely liability lawsuits). In addition to presenting the causes and effects of such errors, the paper also presents measures that can be deployed to reduce errors and avoid liabilities. (shrink)

Under Chinese law, the juridical status of the embryo and the foetus is unclear, mainly because the existing legislation can be subject to diverse interpretations due to its ambiguous language. Lack of clarity with the law has led to different understandings amongst Chinese legal scholars. However, although there has been no consensus, there has been a clear tendency to deprive embryos and foetuses of legal status or personhood, thereby excluding them from entitlement to fundamental rights, an understanding reinforced by the (...) Confucian view of the beginning of life. It is expected that in the near future the Chinese courts will face issues involving embryos and foetuses more often, such as disputes over in vitro embryos. The lack of legal precedent could result in contradictory resolutions, therefore, the law should clarify the legal status of embryos and foetuses and accord to prenatal life special respect and treatment. In March 2020, the Portuguese Government issued a remarkable regulation by which irregular migrants who had previously started the regularization procedure were temporarily regularized and thus allowed full access to all social benefits, including healthcare. The Portuguese constitutional and legal framework is particularly generous regarding the right to healthcare to irregular migrants. Nevertheless, until now, several practical barriers prevented full access to healthcare services provided by the national health service, even in situations in which it was legally granted. This decision (...) is not only remarkable in light of the fulfilling of migrants’ rights to health, as imposed by international commitments assumed by, but also in view of the fight against COVID-19. The decision is grounded both on human rights and in public health reasons. The paper is divided in two main parts. In the first one, it analyzes national State obligations with regard to healthcare provision to migrants in irregular situation. In the second part, it analyzes the Portuguese solution, using this case study to discuss the possible mechanisms to comply with such obligations. (shrink)

Adolescence is a period of several changes and a time when young people are confronted with some difficult tasks of dealing with a diversity of emotions and building their own identity. Therefore, it is a period of higher vulnerability for the development of internalizing problems. The present paper aims to study some constructs considered relevant to adolescents’ adjustment and/or internalizing disorders, emphasizing the role of well-being, emotional regulation and family environment. Therefore, this research aims to test the mediating role of (...) well-being in the relationship between emotional regulation difficulties, the family environment, and internalizing problems, and understand the differences between adolescents with a higher and lower risk of presenting internalizing problems. In the study, 723 adolescents of both sexes from middle to high school completed self-report questionnaires. The results indicated that the mediating role of well-being was partially established between emotional regulation difficulties and internalizing problems, explaining 31% of the variance in these problems. Well-being was also considered a partial mediator between family environment and internalizing problems, explaining 19 and 26% of the variance, respectively. Furthermore, the group with a higher risk of developing internalizing problems revealed higher levels of emotional regulation difficulties and family conflict. In contrast, this group reported less family cohesion and support and lower levels of well-being. The main results of the present study provide relevant data in the context of clinical practice. Important implications are also discussed for the design of psychopathology prevention programs and the promotion of global well-being with adolescents. Considering the limitations of the present study, such as the nonrandom sampling process and the reduced number of participants included in the clinical group, these results need to be deepened in future research in this area. This paper presents a comprehensive description of the STEAM City Kit project, an exploratory project developed according to a Framework for Innovation process model, as part of the Aveiro Tech City project, and designed for primary school students and teachers. The kit, which consists of 2 children’s stories with hands-on activities, an Arduino, and a wide range of sensors, was developed by a transdisciplinary team from the University of Aveiro and distributed to over 30 schools in the municipality of Aveiro, (...) Este artículo aborda la relación entre memoria, identidad y territorio, utilizando como anclaje del argumento las diversas prácticas conmemorativas post-dictadura que se desarrollan en Villa Francia, población emblemática de la ciudad de Santiago. Esta relación se traduce en la ocupación de la calle, en tanto territorio donde la memoria se emplaza, a la vez que es parte misma de los objetos de memorialización. La ocupación de la calle es el resultado de encuentros y desencuentros en el tiempo, que involucran tanto (...) los contenidos de la memoria, como las características materiales y simbólicas de las prácticas conmemorativas que se sostienen en el espacio público. Marginales en forma y contenido de aquellas promovidas por el Estado, estas prácticas interpelan y obligan a girar la mirada hacia la comprensión de la calle como el resultado de lo múltiple, de lo deseado y no deseado, fruto de la acción práctica de la identidad en el territorio. Inaugurated in 1965, the Calouste Gulbenkian Planetarium (CGP) was the first institution of its kind in Portugal. The CGP was established in the context of the relocation of the Maritime Museum of Lisbon (Museu de Marinha) to Belém, an area of the Portuguese capital highly symbolic of Portuguese maritime and imperial history. The dictatorial regime known as Estado Novo used Belém as a ground for major events that affirmed the legitimacy of Portugal’s overseas empire by celebrating the maritime deeds of (...) erstwhile sovereigns and navigators, in a mythical narrative of a glorious imperial destiny. Given the close association between astronomy and nautical science, the CGP was certain to gain a prominent place in the tapestry of Belém’s symbolic inscriptions. This paper addresses the inception of the CGP in its urban context, showing how this area of Lisbon provided an ideal backdrop for this institution, and how its foundation was promoted and steered by a naval officer and amateur astronomer who maintained an ambivalent relation with the regime: Eugénio da Conceição Silva (1903–69). SummaryIn 1905 the Campos Rodrigues Observatory was founded in Lourenço Marques, the capital of Mozambique, by then part of the Portuguese overseas empire. In this paper the inception and early history of the CRO are analysed in the broader context of the interwoven history of the Portuguese and British empires in Africa, and specifically with respect to the scientific relations between Mozambique and South Africa. The equipment, personnel, practices and networks involved in the inception and early development of the CRO (...) are brought into focus in order to illustrate the problems and strategies that shaped the establishment and functioning of this observatory, which was conceived essentially as a symbol of imperial stamina and colonial prowess. It is suggested that by providing a focal point for the development of scientific relations between Mozambique and South Africa, the CRO served both Portuguese ambitions for recognition as an imperial power and the emergence of South African nationalism. En este artículo propongo denominar insondable al concepto de pensar en Heidegger para referirme tanto al pensar como acontecimiento, como a aquello a lo que se refiere el pensar. Se trata, por una parte, del pensar pensante, reflexionante, meditativo que se da precisamente en el tránsito que va de una metafísica de la representación al pensamiento que ha de pensar la verdad del ser. Pero lo insondable hace referencia también al qué del pensar, al misterio del ser que es siempre (...) el misterio de una donación abierta que no se deja encapsular en el férreo dogmatismo de ningún sistema. Lo primero nos sitúa ante el final de la filosofía tal y como ha sido concebida hasta ahora. Lo segundo, ante el inicio de un pensar auténtico del ser que, en nuestra opinión, es a la vez contemplativo y crítico y a la vez que posibilita renovar la relación del hombre con el mundo, con lo ente, marcada por la serenidad consecuente con el cuidado. The influence of Saint Augustine in the existential analysis of Being and Time is highly recognized and is always a source of fruitful research. Our work, however, will try to discover the elongated shadow of the bishop of Hippo in the definition of the task of thinking, and therefore in II Heidegger, from what we will call the salvation of the vital-existential moment of the experience of the encounter with the absolute. It is investigated here, then, the possibility that the (...) fundamental notes on which, in our opinion, the mystical experience that is inferred in the Confessions can count as formal indicators of what is the heideggerian notion of meditative thinking. RESUMEN Frente a la hybris de la subjetividad que culmina en el proyecto moderno-humanista, surge la necesidad de pensar de otra manera la esencia del hombre ya sin el lastre de toda la tradición filosófica occidental. Este viraje que Heidegger imprime al pensar se explica aquí desde lo que denomino tesis para la reconstrucción de un posthumanismo en la perspectiva de la kénosis y que se resume en: la superación de las leyes de la gramática y el acento en el (...) decir poético; el reconocimiento del mientras tanto de la existencia humana finita siempre en camino; y, por último, el preciso abajamiento del pensar tal y como corresponde no ya a la incontestable potestad del señor del ente sino a la esencial pobreza del pastor. ABSTRACT Before the hybris of subjectivity that culminates in the modern-humanist project, there arises the need to think the essence of man, in another way, a way already without the burden of the entire western philosophical tradition. This turn that Heidegger gives to thinking is here explained from what I call: thesis for the reconstruction of post-humanism in the perspective of kenosis, which can be summarized as overcoming the laws of grammar and accent in the poetic saying, recognition of a meanwhile of the finite human existence always on its way and, finally, the precise reduction of thinking as it corresponds not to the power of the lord of the being but to the essential shepherd’s poverty. A ces (...) mérites, on ajoutera une curiosité insatiable, un goût prononcé pour l'échange et le débat, un refus distingué de l'académisme, un sens exigeant de l'amitié et une méfiance profônde pour les adjectifs... Object relative clauses are harder to process than subject relative clauses. UnderGrillo’s (2009)Generalized Minimality framework, complexity effects of object relatives are construed as intervention effects, which result from an interaction between locality constraints on movement (Relativized Minimality) and the sentence processing system. Specifically, intervention of the subject DP in the movement dependency is expected to generate a minimality violation whenever processing limitations render the moved object underspecified, resulting in compromised comprehension. In the present study, assuming Generalized Minimality, we compared the (...) processing of object relatives with the processing of subject control in ditransitives, which, like object relatives, instantiates a syntactic dependency across an intervening DP. This comparison is justified by the current debate on whether Control should be analyzed as movement: if control involves movement of the controller DP, as proposed byHornstein (1999), a parallel between the processing of object relatives and subject control in ditransitives may be anticipated on the basis of intervention. In addition, we explored whether general cognitive factors contribute to complexity effects ascribed to movement across a DP. Sixty-nine adult speakers of European Portuguese read sentences and answered comprehension probes in a self-paced reading task with moving-window display, comprising four experimental conditions:Subject Relatives;Object Relatives;Subject Control;Object Control. Furthermore, participants performed four supplementary tasks, serving as measures of resistance to interference, lexical knowledge, working memory capacity and lexical access ability. The results from the reading task showed that whereas object relatives were harder to process than subject relatives, subject control was not harder to process than object control, arguing against recent movement accounts of control. Furthermore, we found that whereas object relative complexity effects assessed by response times to comprehension probes interacted with Reading Span, object relative complexity effects assessed by comprehension accuracy and reading times did not interact with any of the supplementary tasks. We discuss these results in light of Generalized Minimality and the hypothesis of modularity in syntactic processing (Caplan and Waters, 1999). (shrink)
